1. Definitions

In these terms and conditions, the following definitions shall apply:

• Eye4Audio: the user of these general terms and conditions, located in Diessen.
  
• Customer: Any individual or legal entity using Eye4Audio's services or products.
  
• Services: supplying and installing audio equipment, CarPlay systems and other electronics in vehicles.
  
• Products: the physical goods supplied by Eye4Audio.
  
• Agreement: any agreement between Eye4Audio and the customer regarding delivery of products and/or services, in any form.
  

2. Applicability

2.1 These terms and conditions shall apply to all offers, quotations, agreements, deliveries, installations and other performance of Eye4Audio.
2.2 Deviations from these terms and conditions are valid only if agreed in writing.
2.3 General terms and conditions of the customer are expressly rejected.
2.4 These terms and conditions also apply to verbal appointments, telephone appointments and appointments through digital communication channels such as WhatsApp, e-mail or text message.
2.5 By making an appointment, assignment or order, the client agrees to these terms and conditions.

3. Quotations and formation of the agreement

3.1 All quotes by Eye4Audio are without obligation and valid for 14 days unless otherwise stated.
3.2 An agreement is established when the customer accepts an offer, confirms an appointment (verbally or in writing), or makes a down payment.
3.3 Eye4Audio reserves the right to refuse orders without reason.

4. Down payment and payment

4.1 When making an appointment, a deposit of at least 25% of the agreed amount is required, unless otherwise agreed in writing.
4.2 The remaining payment must be paid immediately by PIN or cash on the day of installation or delivery.
4.3 Eye4Audio retains ownership of all products until full payment is received.
4.4 In the event of late payment, statutory interest and reasonable collection costs shall be due in accordance with the Collection Costs Act.

5. Cancellation and modification

5.1 In case of cancellation by the customer, regardless of the reason, the deposit is non-refundable.
5.2 Changes to appointments are possible up to 48 hours before the scheduled time. In case of subsequent changes, Eye4Audio reserves the right to charge a fee.
5.3 In case of force majeure (such as illness, breakdown, weather conditions), Eye4Audio may reschedule the appointment free of charge. The deposit will remain valid in this case.

6. Performance of services

6.1 Eye4Audio shall perform installation work with skill and in accordance with applicable technical standards.
6.2 Installations shall take place exclusively in Eye4Audio's workshop, unless otherwise agreed in writing.
6.3 The customer shall ensure the timely and correct delivery of the vehicle.

7. Warranty

7.1 A warranty period of 12 months for installation defects applies to the installation work carried out, provided it is not caused by improper use or external damage.
7.2 Only the manufacturer's warranty applies to delivered products.
7.3 The warranty is void if:

• products or installations have been modified or removed by third parties;
  
• damage occurs due to moisture, overheating, improper connection or short circuit;
  
• operating instructions have not been followed.
  

8. Liability

8.1 Eye4Audio shall only be liable for direct damages resulting from intent or gross negligence.
8.2 Eye4Audio's liability shall be limited to the invoice amount of the service or delivery in question.
8.3 Eye4Audio shall not be liable for:

• consequential or indirect damages, such as loss of vehicle functions, lost profits or expired manufacturer's warranties;
  
• damage caused by improper use, modifications by third parties or external influences.
  8.4 The customer is responsible for reporting any modifications to their vehicle to the insurance company, leasing company or other parties involved.
  

9. Right of withdrawal (only for consumers in distance sales).

9.1 In the case of distance selling, the consumer has 14 days for reflection from the day of order confirmation.
9.2 If the customer expressly requests to start the installation within this period, the right of withdrawal expires as soon as Eye4Audio begins the work.
9.3 Custom work and services that have already been performed (in part) within the cooling-off period are excluded from revocation in accordance with Article 6:230p of the Dutch Civil Code.

10. Complaint Resolution

10.1 Complaints should be reported in writing no later than 7 days after discovery at info@eye4audio.nl.
10.2 Eye4Audio will address the substance of the complaint within 14 days and, if necessary, propose a solution.
10.3 In the event of a justified complaint, repairs, replacements or (partial) credit will be made at Eye4Audio's discretion.

11. Force Majeure

11.1 Eye4Audio shall not be liable for delays or failures caused by force majeure. Force majeure includes, but is not limited to: illness, power outages, fire, government measures, pandemics, natural disasters and logistical problems.
11.2 If the force majeure situation continues for more than 30 days, both parties have the right to terminate the agreement in writing.

12. Privacy (AVG).

12.1 Eye4Audio processes personal data solely for the purposes of agreement fulfillment, customer management, billing and service.
12.2 Data will be kept confidential and not disclosed to third parties unless required by law.
12.3 Please see our privacy statement for more information about your rights and our policies in accordance with the General Data Protection Regulation (GDPR).

13. Applicable law and disputes.

13.1 All legal relationships with Eye4Audio shall be governed exclusively by Dutch law.
13.2 Disputes shall preferably be resolved by mutual agreement. If necessary, the dispute shall be submitted to the competent judge of the court in the district where Eye4Audio is located.
